The RallyFuel Gameday Giveaway Sweepstakes (the "Sweepstakes") is sponsored by Gamefuel, LLC d/b/a RallyFuel (the "Sponsor" or "RallyFuel"). By participating in the Sweepstakes, you ("Entrant") unconditionally accept and agree to comply with, and be bound by these Official Rules (the "Official Rules") and the decisions of RallyFuel, which shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
By participating in the Sweepstakes, you hereby represent and warrant that you have read and agree to be bound by these Official Rules, our Terms of Service (available at https://rallyfuel.com/terms), our Privacy Policy (available at https://rallyfuel.com/privacy), and any and all other terms and conditions relating to the Sweepstakes. In the event you do not agree to be bound by these Official Rules and/or the Terms and Services, Privacy Policy, or other terms and conditions relating to the Sweepstakes, your sole remedy shall be to not enter the Sweepstakes and/or to withdraw and discontinue your participation in the Sweepstakes.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE SWEEPSTAKES IS VOID WHERE PROHIBITED BY LAW.
ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
1. ELIGIBILITY:
You must register a RallyFuel account in order to enter the Sweepstakes. The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia. Must be at least eighteen (18) years of age or older (nineteen [19] years of age or older in Alabama and Nebraska; twenty-one [21] years of age or older in Mississippi) at the time of entry. Void in Puerto Rico, Guam, the U.S. Virgin Islands, all other U.S. territories and possessions, overseas military installations, and where prohibited or restricted by law. Employees of the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and their immediate family members (spouse, parents, children, siblings, and their respective spouses) and/or those living in the same household of each are not eligible to enter or win.
2. SWEEPSTAKES PERIOD:
The Sweepstakes begins at 09:00:00 AM Eastern Time (“ET”) on August 18, 2025 and ends at 03:59:59 PM ET on August 22, 2025 (the “Sweepstakes Period”). Sponsor’s computer is the official timekeeping device for this Sweepstakes.
3. HOW TO ENTER:
To enter the Sweepstakes:
- Fuel Entries: During the Sweepstakes Period, Entrants shall receive one (1) entry into the Sweepstakes by visiting https://rallyfuel.com/ and successfully completing one (1) purchase of Conditional NIL Engagement Rights for any athlete and an Affiliated School ("Fuel Entries"). Entrants must comply with all terms and conditions and/or other applicable rules/guidelines put in place by RallyFuel in making a purchase in order to receive a Fuel Entry. You may be eligible to receive Fuel Entries for each purchase of Conditional NIL Engagement Rights made on the platform.
- RallyFuel Point Entries: Entrants can receive one (1) entry into the Sweepstakes per 100 RallyFuel points redeemed on the Platform. To redeem RallyFuel points, please visit https://rallyfuel.com/giveaways
- Mail-in Entries: Entrants may enter the Sweepstakes by legibly hand printing their full name, complete mailing address, valid phone number, and the email address linked to their RallyFuel account on a 3"x5" card. This card must then be placed in a business-size envelope with proper postage affixed and mailed to: RallyFuel Giveaways, 901 34th Ave N, PO Box 7298, Saint Petersburg, FL, 33704-9998
- Each Mail-in Entry must be postmarked by July 31, 2025, and received by August 7, 2025. Limit one (1) Mail-in Entry per person per day.
All Entries become the property of the Sponsor and will not be acknowledged or returned. Photocopied, illegible, or mechanically reproduced Entries are void. Entries received that are from ineligible entrants will be void. Entries that are determined to be fraudulent will be void, and the person making such entry may be barred from further participation in the Sweepstakes and, in RallyFuel's sole discretion on a case by case basis, banned from any future participation in any future sweepstakes. Sponsor is not responsible for lost, late, damaged, misdirected, or postage-due mailed entries.
4. PRIZE:
One (1) prize will be awarded, consisting of two (2) tickets to the Texas vs. Ohio State football game on August 30, 2025. All prizes hereunder are offered "AS IS" without warranty either expressly or in an implied fashion.
5. ODDS OF WINNING:
The odds of winning the prize depend upon the total number of eligible entries received during the Sweepstakes Period. The winner will be determined by random draw conducted by RallyFuel.
6. PRIZE CONDITIONS:
The winner will be notified by the Sponsor via email linked to their RallyFuel account within forty-eight (48) hours after the Sweepstakes Period ends. The prize is not transferable or redeemable for cash, credit, or any other items. No substitution of prize is permitted, except at the sole discretion of the Sponsor. The winner is solely responsible for any and all federal, state, local, and income taxes associated with winning the prize. Winner is responsible for all costs associated with attending the event, including transportation, lodging, meals, and incidental expenses. The winner must claim the tickets within thirty (30) days of notification ("Notice Period"). Prize tickets will not be replaced if lost or stolen.
7. GENERAL RULES:
By entering, Entrants agree to comply with and be bound by these Official Rules and the decisions of the Sponsor. RallyFuel reserves the right, in its sole discretion, to disqualify any entries that are deemed fraudulent, incomplete, in violation of these Official Rules, or that tamper with the entry process. RallyFuel is not responsible for any errors, delays, or lost, late, misdirected, damaged, or incomplete entries. Not responsible for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind.
8. PUBLICITY RELEASE:
Except where prohibited by law, entry into the Sweepstakes and acceptance of the prize constitutes permission for the Sponsor to use the winner's name, city, state, likeness, photograph, voice, and prize information for advertising, marketing, and promotional purposes. May be used in any media now known or hereafter devised, worldwide, in perpetuity, without additional compensation, notification, or permission.
9. LIMITATION OF LIABILITY:
Released Parties shall not be liable for any injury, losses, or damages of any kind to Entrants or any other persons. Not responsible for personal injury or death, or property damage caused or claimed to be caused by participation in the Sweepstakes. Not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the prize. Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if fraud, technical failures, or other factors impair the integrity or proper functioning of the Sweepstakes.
10. GOVERNING LAW AND LIMITATION OF REMEDIES:
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules will be governed by and construed in accordance with the internal laws of the State of Florida. Entrants waive the ability to bring claims in a class action format. Any and all claims, judgments, and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00). Entrants' remedies are limited to a claim for money damages (if any), and Entrant irrevocably waives any right to seek injunctive or equitable relief.
BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS' REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY), AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
11. ARBITRATION AGREEMENT:
The parties hereto each agree to finally settle all disputes relating to the enforcement of these Official Rules through arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings. Arbitration will be conducted under the streamlined Arbitration Rules and Procedures of JAMS Inc. ("JAMS"). If an in-person hearing is required, then it will take place in Miami, Florida. Sponsor agrees to pay the administrative and arbitrator's fees in order to conduct the arbitration.
12. PRIVACY:
As a condition of entering the Sweepstakes, each Entrant gives consent for Sponsor to obtain and deliver their name, address, and other information to third parties for the purpose of administering this Sweepstakes. Any information Entrant provides to Sponsor may be used to communicate with Entrant in relation to this Sweepstakes or on a Sweepstakes winner's list. Personal information collected from Entrants is subject to the Sponsor's Privacy Policy, which can be found at https://rallyfuel.com/privacy.
